The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records February 10, 2025 SPR25/0344 Anne Mahoney Assistant Town Administrator Town of Holbrook 50 North Franklin Street Holbrook, MA 02343 Dear Ms. Mahoney: On February 5, 2025, this office received the petition of Attorney James Donnelly of Murphy, Hesse, Toomey & Lehane, LLP., on behalf of the Town of Holbrook (Town) requesting permission to charge for time spent segregating or redacting responsive records. G. L. c. 66, § 10(c); G. L. c. 66, § 10(d)(iv); see also 950 C.M.R. 32.06(4). As required by law, it is my understanding that the Town furnished a copy of the petition to the requestor, Martha Barrows. G. L. c. 66, § 10(c); G. L. c. 66, § 10(d)(iv)(2). On January 22, 2025, Ms. Barrows requested “…[e]mails from October 26, 2024 to present, from [an identified individual] to the following email addresses:...” Subsequently, in an email to the Town and this office on February 5, 2025, Ms. Barrows states “…[I] am happy to reimburse the Town in the amount of $25.00 for the requested records. [I] will put a check for $25.00 in the mail to the Town Clerk of Holbrook.” In light of the above, it is unnecessary to opine on the Town’s petition requesting permission to charge for time spent segregating or redacting responsive records.
