Records Access Officer Berkshire District Attorney’s Office 7 North Street Pittsfield, MA 01201 Dear Attorney Pieropan: I have received the petitions of Emma Rindlisbacher appealing the nonresponse of the Berkshire District Attorney’s Office (Office) to three requests for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). In three separate requests on January 6, 2025, Ms. Rindlisbacher requested the following: SPR25/0367: “. . . all copies of communications to/from probation officers (including but not limited to [an identified individual]) regarding [an identified individual].” SPR25/0368: “. . . all copies of communications to/from probation officers (including but not limited to [an identified individual]) regarding [an identified individual].” SPR25/0369: “. . . copies of all copies of jail tablet messages between [identified individuals].” Claiming to not yet have received responsive records, Ms. Rindlisbacher petitioned this office and the following appeals, SPR25/0367, SPR25/0368, and SPR25/0369, were opened as a result. Despite being notified of the opening of these appeal, it remains unclear whether the Office has provided a response(s).
