The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records February 18, 2025 SPR25/0379 Diane Pelland Town Clerk Town of Swansea 81 Main Street Swansea, MA 02777 Dear Ms. Pelland: I have received the petition of Geraldine Mullaly appealing the response of the Town of Swansea (Town) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On January 25, 2025, Ms. Mullaly requested, “[f]or FY 2025, please provide copies of the following: [1] purchase/lease/rental/etc. documents relative to new/used vehicles acquired by the Highway Dept. [2] Condition of account(s) recording the transaction(s)/expenditures outlined in bullet #1[.]” The Town responded on February 4, 2025, providing responsive records. On February 5, 2025, Ms. Mullaly made an additional request for “the copies of the ‘warrant approved by the selectmen[,]’ for each invoice contained in FY2025 Highway Equipment Purchase – Rental (9 MB).” The Town responded on February 6, 2025. Unsatisfied with the Town’s response, Ms. Mullaly appealed, and this case, SPR25/0379, was opened as a result. Subsequently, the Town provided a supplemental response on February 10, 2025. Where this appeal was opened as a result of the Town’s February 6th response, I will now consider this administrative appeal closed. Ms. Mullaly may appeal the substantive nature of the Town’s February 10th response within ninety days. See 950 C.M.R. 32.08(1).
