See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On January 22, 2025, Ms. Palmer requested, “…for the period of Oct. 1, 2024 through December 31, 2024, all data available regarding monthly revenues, minutes, and volumes (or number of calls) for phone calls, video calls and e-messages by incarcerated people in your custody.” On February 6, 2025, the Department acknowledged the request stating, “…[w]e will respond to your public request accordingly. The Department reserves all rights to assert privileges or exemptions, as applicable.” On February 14, 2025, Ms. Palmer petitioned this office and this appeal, SPR25/0449, was opened. Subsequent to the opening of this appeal, I learned that the Department provided Ms. Palmer with a further response on February 25, 2025, which included responsive records. Where the basis of this appeal was opened as a result of the Department’s February 6th response, I will now consider this administrative appeal closed. Ms. Palmer may appeal the substantive nature of the Department’s February 25th response within ninety days. See 950 C.M.R. 32.08(1).
