The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records February 26, 2025 SPR25/0450 Daniel Sheridan Assistant Superintendent/General Counsel Berkshire County Sheriff's Office 467 Cheshire Road Pittsfield, MA 01201 Dear Attorney Sheridan: I have received the petition of Anna Palmer appealing the nonresponse of the Berkshire County Sheriff’s Department (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On January 22, 2025, Ms. Palmer requested, for the period of Oct 1, 2024, through Dec 31, 2024, “all data available regarding monthly revenues, minutes, and volumes (or number of calls) for phone calls, video calls and e-messages by incarcerated people in your custody.” Claiming to not yet have received responsive records, Ms. Palmer petitioned this office and this appeal, SPR25/0450, was opened as a result. Subsequently, I learned that the Department provided Ms. Palmer with a response on January 29, 2025. Where this appeal was opened as a result of the Department’s lack of a written response, I will now consider this administrative appeal closed. Ms. Palmer may appeal the substantive nature of the Department’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
