The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records February 24, 2025 SPR25/0505 Sofya Gray Records Access Officer Office of the Secretary of the Commonwealth Administrative Services Division One Ashburton Place, Room 1710 Boston, MA 02108 Dear Ms. Gray: I have received the petition of Mitchell Kosht, Esq., of Thomas Oakley PLLC, appealing the nonresponse of the Office of the Secretary of the Commonwealth (Office) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On February 3, 2025, Attorney Kosht requested: [1] [A]n identified] spreadsheet…[;] [2] [A]ll reports submitted to the Secretary by the Massachusetts Department of the State Police (MSP), or any subdivision thereof, pursuant to 950 Code Mass. Regs. 32.05 (1)(c), for the year 2024[;] [3] [A]ll communications between MSP and the Office of the Secretary of the Commonwealth regarding the data MSP is required to submit pursuant 950 Code Mass. Regs. 32.05 (1)(c), including any emails, qualifications, explanations or questions regarding that data or regulatory provision from 2021 to the present. Claiming to not yet have received responsive records, Attorney Kosht petitioned this office and this appeal, SPR25/0505, was opened as a result. Subsequently, I learned that the Office provided Attorney Kosht with a response on February 24, 2025. Where this appeal was opened as a result of the Office’s lack of a written response, I will now consider this administrative appeal closed. Attorney Kosht may appeal the substantive nature of the Office’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
