Records Access Officer Massachusetts Department of Transportation 10 Park Plaza Boston, MA 02116 Dear Attorney Doyle: I have received the petition of Ray Fuschetti, of Pedal Safe Boston, appealing the response of the Department of Transportation (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On February 4, 2025, Mr. Fuschetti requested, “records related to citations and/or warnings issued to drivers in the City of Boston for bike lane- related infractions for the years 2023, 2024, and 2025.” Specifically, Mr. Fuschetti sought the following information for each citation or warning issued: [1] Date of incident[;] [2] Type of incident (e.g., parking in a bike lane, failure to yield, blocking a bike lane, etc.)[;] [3] Whether the incident resulted in an injury[;] [4] Type of citation or warning issued[;] [5] Date and time of the violation[;] [6] Location of the violation (street name and intersection if available)[;] [7] Issuing agency (e.g., Boston Police Department, Massachusetts State Police, etc.)[.] The Department responded on February 13, 2025. Unsatisfied with the Department’s response, Mr. Fuschetti petitioned this office and this appeal, SPR25/0534, was opened as a result. Subsequently, I learned that the Department provided further responses to Mr. Fuschetti on February 24, 2025 and February 26, 2025. Where this appeal was opened as a result of the Department’s February 13, 2025 response, I will now consider this administrative appeal closed. Mr. Fuschetti may appeal the substantive nature of the Department’s responses within ninety (90) days. See 950 C.M.R. 32.08(1).
