Collins, of Level Investigations of New England, Inc., appealing the response of Massachusetts Peace Officer Standards and Training Commission (Commission) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On December 5, 2024, Mr. Collins requested “…any and all information in the possession of POST that addresses the following, regardless of the ultimate findings or conclusions of any investigation that may have occurred,” including: [1] Identify and provide any POST created or recommended policies that would regulate or enforce a local police department to perform an internal investigation after an officer involved shooting, what that investigation should involve, and/or methods and standards to apply upon adjudicating it. [2] Identify and provide any POST created or recommended policies that would regulate or discourage the transfer of a sworn police officer to another police department amidst an officer involved shooting related internal investigation or as a result of the partial or complete findings of an officer involved shooting internal investigation. [3] Identify and provide any information from the Easton Police Department in the possession of POST regarding the internal investigation and/or possible complaints resulting from an officer involved shooting on December 16, 2018 in Easton, Massachusetts. [5] Identify and provide any information from the Massachusetts State Police Department in the possession of POST regarding complaints and/or investigations involving either [identified individuals] while they were members of the Easton Police Department prior to, or involving, this officer involved shooting on December 16, 2018. [6] Identify and provide any information from the Boston Police Department in the possession of POST regarding complaints and/or investigations involving [an identified individual] while he was a member of the Easton Police Department prior to, or involving, this officer involved shooting on December 16, 2018, or while a member of the Boston Police Department following the same incident. The Commission provided a response on December 18, 2024. Unsatisfied with the Commission’s response, Mr. Collins petitioned this office and this appeal, SPR25/0555, was opened as a result. Subsequently, I learned that the Commission responded to Mr. Collins’ request with a further response sent on February 26, 2025. Where this appeal was opened as a result of the Commission’s December 18, 2024 response, I will now consider this administrative appeal closed.
