Counsel, Public Records Officer Executive Office of Housing and Livable Communities 100 Cambridge Street Boston, MA 02114 Dear Attorney Walleigh: I have received the petition of Colman Herman appealing the response of the Executive Office of Housing & Livable Communities (Office) to a request for public records. See G. L. c. 66 § 10A; see also 950 C.M.R. 32.08(1). On January 27, 2025, Mr. Herman requested, “Governor Maura Healey has said that she delivered an order last year to conduct system-wide background checks in the state’s emergency shelter system, a step she later said was never taken despite her directive sometime last spring. In that regard, please provide me with copies of any and all communications related to this matter.” On February 6, 2025, the Office provided a response. Unsatisfied with the Office’s response, Mr. Herman petitioned this office and this appeal, SPR25/0573, was opened as a result. On February 7, 2025, and in a telephone conversation, Mr. Herman agreed to modify his request to ‘the order.’” Subsequently, I learned that the Office sent a further response to Mr. Herman on March 5, 2025. Where this appeal was opened as a result of the Office’s February 6th response, I will now consider this administrative appeal closed. Mr. Herman may appeal the substantive nature of the Office’s March 5th response within ninety (90) days. See 950 C.M.R. 32.08(1).
