See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On February 13, 2025, Mr. Gerhardson requested the following: Records related to the city/town of Arlington’s use of money received through the Statewide Opioid Settlement, including the following: - FY2023, FY2024 municipal expenditure report as submitted to caremass.org - the city’s balance sheet for its opioid settlement funds account - records related to expenditures made from this account, or with settlement funds that demonstrate what the money was spent on, for what purpose, who was paid, etc. Claiming to not yet have received responsive records, Mr. Gerhardson petitioned this office and this appeal, SPR25/0589, was opened as a result. Subsequently, I learned that the Town intends on providing a response to Mr. Gerhardson. Accordingly, the Town is ordered to provide Mr. Gerhardson with said response in accordance with the Public Records Law, its Regulations, and this order within ten business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. Mr. Gerhardson may appeal the substantive nature of the Town’s response within ninety days. See 950 C.M.R. 32.08(1).
