Associate General Counsel Cannabis Control Commission Union Station 2 Washington Square Worcester, MA 01604 Dear Attorney Bergquist: I have received the petition of Malden News Network (requestor) appealing the nonresponse of the Cannabis Control Commission (Commission) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On February 12, 2025, the requestor sought the following: [1] Any records detailing guidelines, rules, or applicable laws governing ownership in more than one Marijuana Retail Establishment, whether within Massachusetts or cross state lines; [2] Any and all email communications (with attachments) made or received by any representative, employee or contractor acting on behalf of the [Commission] involving DMS Trinity, LLC (whether under License Number MR282590 or any other application number), its known owners, identified representatives for the dates from 10/1/24 to the date you receive this request; [3] Any records created or on file from 10/1/24 to the date [the Commission] received this request describing corporate or organizational structure, including any records documenting persons with direct or indirect authority, their capital/financial contribution and percent of ownership of any such entity associated with DMS Trinity, LLC; and, [4] Finally, please provide any records in your custody or control concerning any financing, loans, or sources of non-ownership capital, including financial terms, agreements, letters of intent, private financiers, bankers or agreements being used to fund, operate any entity which shares ownership with DMS Trinity, LLC. Claiming to not yet have received responsive records, the requestor petitioned this office and this appeal, SPR25/0633, was opened as a result. Where this appeal was opened as a result the Commission’s lack of a written response, I will now consider this administrative appeal closed. The requestor may appeal the substantive nature of the Commission’s March 7th response within ninety days. See 950 C.M.R. 32.08(1).
