The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records March 11, 2025 SPR25/0641; SPR25/0643 Leo Mercado Town Clerk Town of Acton 472 Main Street Acton, MA 01720 Dear Mr. Mercado: I have received the petitions of Anonymous Requestor (requestor), appealing the nonresponse of the Town of Acton (Town) to requests for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On February 20, 2025, in two separate requests, the requestor sought: SPR25/0641 [1] [T]he current contract and fee agreement for Acton’s Town Counsel[;] [2] [R]ecords of appointment of Acton’s Town Counsel, including recorded Select Board votes, for the past seven one-year appointment terms July 1, 2019 through the current term). SPR25/0643 [1] [T]he Town of Acton’s in-effect Certificate of Insurance. Claiming to not yet have received responsive records, the requestor petitioned this office and these appeals, SPR25/0641 and SPR25/0643, were opened as a result. Subsequently, I learned that the Town provided the requestor with a response on March 10, 2024. Where this appeal was opened as a result of the Town’s lack of a written response, I will now consider this administrative appeal closed. The requestor may appeal the substantive nature of the Town’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
