O. Box 135 Lunenburg, MA 01462 Dear Ms. Warren-Dyment: I have received the petition of Jen and George Burden appealing the response of the Town of Lunenburg (Town) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On March 7, 2025, Mr. and Mrs. Burden requested: [1.] [A]ny and all documentation regarding the costs/expenses relating to payments made to “B&H Foto” which were part of the report relative to Income and Expenses for PACC for the period of 07/01/2019 through 01/15/2025 … [2.] [D]ocumentation associated with “PACC Indirect Costs[.]” Prior Appeal A similar request was the subject of a prior appeal. See SPR25/0637 Determination of the Supervisor of Records (March 11, 2025). In my March 11th determination, I found that the Town had provided Mr. and Mrs. Burden with a response on March 10, 2025. Unsatisfied with the Town’s response, Mr. and Mrs. Burden petitioned this office and this appeal, SPR25/0678, was opened as a result. Subsequent to the opening of this appeal, on March 17, 2025, the Town provided a further response to Item 1 of Mr. and Mrs. Burden’s request. Mr. and Mrs. Burden may appeal the substantive nature of the Town’s March 17th response within ninety days. See 950 C.M.R. 32.08(1). It is my understanding that the Town intends on providing a further response to Item 2 of Mr. and Mrs. Burden’s request. Accordingly, the Town is ordered to provide Mr. and Mrs. Burden with said response, in a manner consistent with this order, the Public Records Law and its Regulations within ten business days.
