The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records March 20, 2025 SPR25/0704 Kristin Burgess Chief of Police Town of Shutesbury 1 Cooleyville Road Shutesbury, MA 01072 Dear Chief Burgess: I have received the petition of Tracy McNaughton appealing the response of the Shutesbury Police Department (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On February 21, 2025, Ms. McNaughton requested the resume of an identified individual who began their employment with the Department in January of 2020. Prior Appeal A similar request was the subject of a prior appeal. See SPR25/0339 Determination of the Supervisor of Records (February 14, 2025). In my February 14th determination, I ordered the Department to revise its assessed fee or provide further explanation of how said fee was consistent with G. L. c. 66, § 10(d). The Department provided a response on March 11, 2025. Unsatisfied with the response, Ms. McNaughton petitioned this office and this appeal, SPR25/0704, was opened as a result. It is my understanding that the Department intends on providing a further response to Ms. McNaughton. Accordingly, the Department is ordered to provide Ms. McNaughton with said response, in a manner consistent with this order, the Public Records Law and its Regulations within ten business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. Ms. McNaughton may appeal the substantive nature of the Department’s response within ninety days. See 950 C.M.R. 32.08(1).
