Purple Town Administrator Town of Southborough 17 Common Street Southborough, MA 01772 Dear Mr. Purple: I have received the petition of Donna Brewer, Esq., of Harrington Heep, LLP, appealing the response of the Town of Southborough (Town) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On February 7, 2025, Attorney Brewer requested: [1] All documents by and between any Town of Southborough employees or officials and the Town of Northborough regarding the provision of services, or use of equipment or personnel, by Northborough Community Access Television (“NCAT”) in the Town of Southborough. [2] All documents concerning the provision of public, educational, and government (“PEG”) access in Southborough, whether through Southborough Access Media, Inc. (“SAM”) or any other entity. [3] All documents concerning the transfer or appropriation of PEG funds. [4] All documents concerning the use or proposed use of PEG funds. [5] All communications regarding SAM. The pertinent date range for these requests is January 1, 2023 to the present. The Town provided responses on February 26, 2025, March 5, 2025, March 12, 2025, and March 13, 2025. Unsatisfied with the Town’s responses, Attorney Brewer petitioned this office and this appeal, SPR25/0740, was opened as a result. Purple SPR25/0740 Page 2 March 28, 2025 Subsequent to the opening of this appeal, based on a telephone conversation between this office and an attorney for the Town on March 19, 2025, I understand that the Town intends to provide a supplemental response to Attorney Brewer. Accordingly, said response must be provided in a manner consistent with the Public Records Law and its Regulations within ten (10) business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. Attorney Brewer may appeal the substantive nature of the Town’s supplemental response within ninety (90) days. See 950 C.M.R. 32.08(1).
