The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records March 21, 2025 SPR25/0767 Lieutenant Joseph Casey Records Access Officer Medford Police Department 100 Main Street Medford, MA 02155 Dear Lieutenant Casey: On March 19, 2025, this office received your petition on behalf of the Medford Police Department (Department) seeking permission to charge for time spent segregating or redacting responsive records. G. L. c. 66, § 10(c); G. L. c. 66, § 10(d)(iv); see also 950 C.M.R. 32.06(4). As required by law, it is my understanding that the Department furnished a copy of the petition to the requestor, Denise Vivolo. G. L. c. 66, § 10(c); G. L. c. 66, § 10(d)(iv)(2). On March 7, 2025, Ms. Vivolo requested body worn camera footage of a specified incident. Subsequently, in an email to Ms. Vivolo and this office on March 21, 2025, the Department stated “… [t]he Department has received payment from Requester Denise Vivolo of a check in the amount of $100, for the fees associated with redaction and production[.]” In light of the above, it is unnecessary to opine on the Department’s petition requesting permission to charge for time spent segregating or redacting responsive records.
