See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On February 28, 2025, Mr. Horrell requested the following records: [1] All staffing matricies (Section 1.2)1 for each DOC Facility and VitalCore’s local administrative office provided by VitalCore to the DOC from the start of the contract to present; [2] The names, business contact information, and professional licensure and credentials (if any) of the VitalCore personnel filling the positions in the current staffing matricies for each DOC facility and VitalCore’s local administrative office; [3] Any staffing analyses completed pursuant to Section 3.4.1(E) from the start of the contract to present; [4] All monthly lists of personnel who have been hired or who have been separated from employment at VitalCore provided by VitalCore to the DOC pursuant to Section 3.4.9(A) from the start of the contract to present; [5] All of the following reports provided by VitalCore to the DOC from the start of the contract to present: [a] Monthly off-facility transfers reports (Section 3.18.2); [b] Monthly clinical services practitioner matrix reports (Section 3.18.3); [c] Monthly nursing matrix reports (Section 3.18.4); and [d] Monthly position control and vacancy reports, including bi-weekly vacancy reports (Section 3.18.5); and [6] Any contract modifications (Section 4.2), amendments (Section 4.7), or waivers (Section 4.10) from the start of the contract to present; and One Ashburton Place, Room 1719, Boston, Massachusetts 02108 • (617) 727-2832 • Fax: (617) 727-5914 sec.state.ma.us/pre • pre@sec.state.ma.us

Kate Silvia SPR25/0791 Page 2 March 31, 2025 [7] Any reports regarding VitalCore’s failure to perform contractual obligations (Section 4.18) from the start of the contract to present. Additionally, please provide me with documents sufficient to show the following related to the 103 DOC 408 – Reasonable Accommodations Policy: [1] The name and business contact information of the Department ADA Coordinator (103 DOC 408.04) and Institutional ADA Coordinators (103 DOC 408.05). The Department provided a response on March 11, 2025. Unsatisfied with the Department’s response, Mr. Horrell petitioned this office and this appeal, SPR25/0791, was opened as a result. It is my understanding that the Department intends on providing a supplemental response. Accordingly, the Department is ordered to provide Mr. Horrell with said response in accordance with the Public Records Law, its Regulations and this order within ten business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us.
