The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records March 27, 2025 SPR25/0798 Leo Mercado Town Clerk Town of Acton 472 Main Street Acton, MA 01720 Dear Mr. Mercado: I have received the petition of Scott Smyers appealing the response of the Town of Acton (Town) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On February 12, 2025, Mr. Smyers requested: [1] Any and all emails between Town Manager [and an identified individual with the] Public Relations Firm between September 1, 2020 and June 1, 2021…. [2] Itemized statements for any and all legal services rendered to the Town of Acton by [an identified individual] from September 1, 2020 – February 10, 2025. [3] Itemized statements for any and all Public Relation services rendered to the Town of Acton by [an identified individual] Public Relations Firm from September 1, 2020- June 1, 2021. The Town provided a response on February 27, 2025. Unsatisfied with the Town’s response, Mr. Smyers petitioned this office and this appeal, SPR25/0798, was opened as a result. Subsequently, the Town provided a supplemental response on March 27, 2025. Where this appeal was opened as a result of the Town’s February 27th response, I will now consider this administrative appeal closed. Mr. Smyers may appeal the substantive nature of the Town’s March 27th response within ninety days. See 950 C.M.R. 32.08(1).
