Assistant General Counsel Division of Occupational Licensure 1000 Washington Street, Suite 710 Boston, MA 02118 Dear Attorney Patel: I have received the petition of Elmir Simov appealing the nonresponse of the Division of Occupational Licensure (Division) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On March 7, 2025, Mr. Simov requested “… a spreadsheet of all the phone numbers and emails of the active plumbers in MA.” Prior Appeal A similar request was the subject of prior appeals. See SPR24/3449 Determination of the Supervisor of Records (January 7, 2025) and SPR25/0429 Determination of the Supervisor of Records (February 27, 2025). In my February 27th determination, I found that Mr. Simov’s request for “… the emails and numbers of all [the Division’s] active licensees” was overbroad in scope, and encouraged Mr. Simov and the Division to communicate further to facilitate providing records more efficiently and affordably. Claiming to have received no response to his amended request, Mr. Simov petitioned this office and this appeal, SPR25/0800, was opened as a result. It is my understanding that the Division intends on providing a further response to Mr. Simov. Accordingly, the Division is ordered to provide Mr. Simov with said response, in a manner consistent with this order, the Public Records Law and its Regulations within ten business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. Mr. Simov may appeal the substantive nature of the Division’s response within ninety days. See 950 C.M.R. 32.08(1).
