Division of Capital Asset Management and Maintenance One Ashburton Place, 15th Floor Boston, MA 02108 Dear Attorney Guerin: I have received the petition of Thomas Wall, of Heat & Frost Insulators & Allied Workers, appealing the nonresponse of the Division of Capital Asset Management and Maintenance (Division) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On March 4, 2025, Mr. Wall requested the following: [1] All CM/GC reports containing OWENS INSULATION or INSULATION pertaining to the HVAC Contract [2] All OPM/PM reports concerning OWENS INSULATION or INSULATION pertaining to the HVAC Contract [3] All Designer/Architect reports concerning OWENS INSULATION or INSULATION pertaining to the HVAC Contract [4] All emails from all entities concerning OWENS INSULATION or INSULATION pertaining to the HVAC Contract [5] All Public Certified Payrolls concerning OWENS INSULATION or INSULATION pertaining to the HVAC Contract[.] Claiming to not yet have received responsive records, Mr. Wall petitioned this office and this appeal, SPR25/0810, was opened as a result. Subsequently, I learned that the Division provided Mr. Wall with a response on April 3, 2025. Where this appeal was opened as a result of the Division’s lack of a written response, I will now consider this administrative appeal closed. Mr. Wall may appeal the substantive nature of the Division’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
