Associate General Counsel Cannabis Control Commission Union Station 2 Washington Square Worcester, MA 01604 Dear Attorney Bergquist: I have received the petition of Christopher Kelleher appealing the nonresponse of the Cannabis Control Commission (Commission) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On January 21, 2025, Mr. Kelleher requested “[a]ll records relating to communications involving the Cannabis Control Commission and any individuals, organizations, or entities regarding the … Molasses Hill Road project (Brookfield) under Sunfusions.” Claiming to not yet have received responsive records, Mr. Kelleher petitioned this office and this appeal, SPR25/0828, was opened as a result. Subsequently, I learned the Commission intends on providing a written response to Mr. Kelleher. Accordingly, the Commission is ordered to provide Mr. Kelleher with said response in accordance with the Public Records Law, its Regulations and this order within ten business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. Mr. Kelleher may appeal the substantive nature of the Commission’s response within ninety days. See 950 C.M.R. 32.08(1).
