The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records April 7, 2025 SPR25/0846 Helene Bettencourt Associate Commissioner Commissioner’s Office Department of Elementary and Secondary Education 135 Santilli Highway Everett, MA 02149 Dear Ms. Bettencourt I have received the petition of Laura Ybarra appealing the response of the Department of Elementary and Secondary Education (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On March 13, 2025, Ms. Ybarra requested, “copies of of [sic] all materials related to PRS Complaint #10119, 10953, and 11385, including but not limited to all Emails received from WRSD, internal communications at MA DESE PRS with a @mass.gov, correction action plan, and any other materials, emails, internal notes or correspondence related to this PRS number…” The Department responded on March 27, 2025. Unsatisfied with the Department’s response, Ms. Ybarra petitioned this office and this appeal, SPR25/0846, was opened as a result. Subsequently, I learned in an email dated April 3, 2025, that the Department intends on providing a further response to Ms. Ybarra. Accordingly, the Department is ordered to provide Ms. Ybarra with said response, in a manner consistent with this order, the Public Records Law and its Regulations within ten business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. Ms. Ybarra may appeal the substantive nature of the Department’s response within ninety days. See 950 C.M.R. 32.08(1).
