Associate General Counsel Executive Office of Energy and Environmental Affairs 100 Cambridge Street, Suite 900 Boston, MA 02114 Dear Attorney Tullis: On April 1, 2025, this office received your petition on behalf of the Executive Office of Energy and Environmental Affairs (Office/EEA) seeking permission to charge for time spent segregating or redacting responsive records. G. L. c. 66, § 10(c); G. L. c. 66, § 10(d)(iv); see also 950 C.M.R. 32.06(4). As required by law, it is my understanding that the Office furnished a copy of the petition to the requestor, Sarah Attie. G. L. c. 66, § 10(c); G. L.c. 66, § 10(d)(iv)(2). On March 17, 2025, Ms. Attie requested the following: [1] Documents, reports, or correspondence from 2020 to 2025 between the Massachusetts Executive Office of Energy and Environmental Affairs (EEA) and Boston University regarding compliance with climate action initiatives, carbon neutrality efforts, and sustainability programs[;] [2] Any records related to state-funded grants, incentives, or policy guidance provided to Boston University for sustainability[.] Subsequently, in an email to this office on April 4, 2025, Attorney Tullis states “I am writing to withdraw EEA’s petition for fees in this matter. The requestor has provided EEA with narrowed search terms and reduced significantly the number of records required to be reviewed. We no longer need to charge any fees.” In light of the above, it is unnecessary to opine on the Office’s petition to charge for segregating or redacting responsive records.
