Devito Records Access Officer Billerica Police Department 6 Good Street Billerica, MA 01821 Dear Sergeant Devito: I have received the petition of Altin Berxhiku appealing the nonresponse of the Billerica Police Department (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On March 19, 2025, Mr. Berxhiku requested the following: [1] Police reports or records: Any official documentation related to the stop involving [identified parties], including the officer’s report, citations, or any other relevant documents [2] Body camera footage: Any available body camera footage or recordings relating to the incident [3] Emails/communications: Any communications regarding the incident, involving internal communications, emails, or memos concerning the stop involving [identified parties.] Claiming to not yet have received responsive records, Mr. Berxhiku petitioned this office and this appeal, SPR25/0916, was opened as a result. Subsequently, I learned that the Department provided Mr. Berxhiku with a response on April 14, 2025. Where this appeal was opened as a result of the Department’s lack of a written response, I will now consider this administrative appeal closed. Mr. Berxhiku may appeal the substantive nature of the Department’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
