See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On March 6, 2025, Mr. Lee requested the following: [1] All information pertaining to the appeal at 0 Nesmith Street dating back to the original date of application of the variance of March 10, 2023 [2] All information, applications, permit requests, correspondence, emails between . . ., Defendant, . . ., Senior Advisor, . . . Mayor, Planning Board, and the Zoning Board of Appeals[.] Claiming to not yet have received responsive records, Mr. Lee petitioned this office and this appeal, SPR25/0969, was opened as a result. Subsequently, I learned that the City provided Mr. Lee with a response on April 14, 2025. Where this appeal was opened as a result of the City’s lack of a written response, I will now consider this administrative appeal closed. Mr. Lee may appeal the substantive nature of the City’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
