Assistant General Counsel/Records Access Officer Office of the Comptroller One Ashburton Place Boston, MA 02108 Dear Attorney Roberts: I have received the petition of Todd Wallack, of WBUR, appealing the response of the Office of the Comptroller (Office) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On February 18, 2025, Mr. Wallack requested, “[r]ecords of state employee names, titles, agency, salaries, overtime, other cash compensation and total cash compensation that are missing from the public online CTHRU database but whose payroll information is in the possession of the state comptroller’s office for calendar years 2023 and 2024.” Prior Appeal This request was the subject of a prior appeal. See SPR25/0569 Determination of the Supervisor of Records (March 27, 2025). In my March 27th determination, I found that the Office had not met its burden to withhold workers’ titles, agency name, salaries, overtime, other cash compensation and total cash compensation under G. L. c. 66, § 10B, as it operates through Exemption (a) of the Public Records Law. The Office responded on April 9, 2025. Unsatisfied with the response, Mr. Wallack petitioned this office and this appeal, SPR25/1005, was opened as a result. It is my understanding that the Office intends on providing a further response to Mr. Wallack. Accordingly, the Office is ordered to provide Mr. Wallack with said response in a manner consistent with the Public Records Law and its Regulations within 10 business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. Mr. Wallack may appeal the substantive nature of the Office’s response within ninety days. See 950 C.M.R. 32.08(1).
