Assistant Corporation Counsel Boston Police Department 1 City Hall Square Boston, MA 02201 Dear Attorney O’Donnell: I have received the petitions of Bay State Body Cam (requestor) appealing the nonresponse of the Boston Police Department (Department) to multiple requests for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). In three separate requests on March 31, 2025, the requestor sought the following: SPR25/1043: [1] …specific records related to the January 11, 2024 arrest of [an identified individual]…Body-worn camera footage from the arresting officer involved, beginning shorty before first contact with the suspect and continuing through to the moment the suspect is placed into the police vehicle. [2] The booking photo of [an identified individual], the individual arrested in connection with the incident. SPR25/1046: …specific records related to the January 11, 2024 arrest of [an identified individual] … Body-worn camera footage from the primary officer involved, beginning shortly before first contact with the suspect and continuing through the moment the suspect is placed into the police vehicle. Claiming to not yet have received responsive records, the requestor petitioned this office and the following appeals, SPR25/1043, SPR25/1046, and SPR25/1047, were opened as a result. Subsequently, I learned that the Department provided the requestor with a response on April 16, 2025. Where these appeals were opened as a result of the Department’s lack of a written response, I will now consider these administrative appeals closed. The requestor may appeal the substantive nature of the Department’s April 16th response within ninety (90) days. See 950 C.M.R. 32.08(1).
