Assistant Corporation Counsel Boston Police Department 1 City Hall Square Boston, MA 02201 Dear Attorney O’Donnell: I have received the petitions of Bay State Body Cam (requestor) appealing the nonresponse of the Boston Police Department (Department) to multiple requests for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). In three separate requests on March 31, 2025, the requestor sought the following: SPR25/1043: [1] …specific records related to the January 11, 2024 arrest of [an identified individual]…Body-worn camera footage from the arresting officer involved, beginning shorty before first contact with the suspect and continuing through to the moment the suspect is placed into the police vehicle. [2] The booking photo of [an identified individual], the individual arrested in connection with the incident. SPR25/1046: …specific records related to the January 11, 2024 arrest of [an identified individual] … Body-worn camera footage from the primary officer involved, beginning shortly before first contact with the suspect and continuing through the moment the suspect is placed into the police vehicle. [2] The booking photo of [an identified individual], the individual arrested in connection with this incident. Claiming to not yet have received responsive records, the requestor petitioned this office and the following appeals, SPR25/1043, SPR25/1046, and SPR25/1047, were opened as a result. Subsequently, I learned that the Department provided the requestor with a response on April 16, 2025. Where these appeals were opened as a result of the Department’s lack of a written response, I will now consider these administrative appeals closed. The requestor may appeal the substantive nature of the Department’s April 16th response within ninety (90) days. See 950 C.M.R. 32.08(1).
