Assistant Corporation Counsel Office of the Legal Advisor Boston Police Department 1 City Hall Square Boston, MA 02201 Dear Attorney O’Donnell: I have received the petition of Bay State Body Cam (requestor) appealing the nonresponse of the Boston Police Department (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On March 25, 2025, the requestor requested the following: [S]pecific records related to the January 3, 2024 incident involving the arrest of a 15-year-old in possession of a firearm in the Back Bay, as outlined in the Boston Police Department’s public release titled.…[W]e are requesting the following: Body-worn camera footage from the primary officer involved, beginning shortly before first contact with the suspect and continuing through to the moment the suspect is placed into the vehicle. Claiming to not yet have received responsive records, the requestor petitioned this office and this appeal, SPR25/1050, was opened as a result. Subsequently, I learned that the Department provided the requestor with a response on April 16, 2025. Where this appeal was opened as a result of the Department’s lack of a written response, I will now consider this administrative appeal closed. The requestor may appeal the substantive nature of the Department’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
