Assistant District Attorney Middlesex District Attorney’s Office 15 Commonwealth Avenue Woburn, MA 01801 Dear Attorney Horn: I have received the petitions of Altin Berxhiku appealing the nonresponse of the Middlesex District Attorney’s Office (Office) to requests for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On April 9, 2025, in two separate requests, Mr. Berxhiku requested: SPR25/1145 [1] All records including, but not limited to, emails, internal notes, phone logs, voicemail metadata, and case file entries reflecting communication between the Middlesex District Attorney’s Office and [an identified individual], concerning [an identified individual], during the period April 12, 2024, through May 3, 2024. [2] [A]ny written records retention policies, SOPs, or internal guidelines used by the Middlesex District Attorney’s Office that govern: The retention or deletion of voicemail messages left by staff or ADAs for external parties; The documentation or logging of phone calls made by your office to external individuals, including attorneys; The retention of internal communications, emails, calendar events, or case management entries that reflect external communications. SPR25/1145; SPR25/1146 Page 2 April 28, 2025 Claiming to not yet have received responsive records, Mr. Berxhiku petitioned this office and these appeals, SPR25/1145 and SPR25/1146, were opened as a result. Subsequently, I learned the Office intends on providing a written response to Mr. Berxhiku. Accordingly, the Office is ordered to provide Mr. Berxhiku with said response in accordance with the Public Records Law, its Regulations and this order within ten business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us.
