Department of Public Utilities Legal Division One South Station, 5th Floor Boston, MA 02110 Dear Attorney Cunha: I have received the petition of Sharon Gregory appealing the nonresponse of the Department of Public Utilities (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On February 3, 2025, Ms. Gregory requested the following: [1] The annual financial reports of the Housatonic Water Works Company in Great Barrington, MA for the years 1984 -2012. [2] The price and terms records for the purchase of the Housatonic Water Works Company by the [identified] family, [i]ncluding the names of specific buyers as well as the name(s) of the seller. I believe the price paid was $1.2 million but would appreciate confirmation [i]ncluding any deferred payments. [3] The names of the law firms and other parties representing each side. This includes the investment bankers and appraisers involved. Claiming to not yet have received responsive records, Ms. Gregory petitioned this office and this appeal, SPR25/1255, was opened as a result. Subsequently, I learned that the Department provided Ms. Gregory with a response on May 7, 2025. Where this appeal was opened as a result of the Department’s lack of a written response, I will now consider this administrative appeal closed. Ms. Gregory may appeal the substantive nature of the Department’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
