See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On April 1, 2025, Ms. Batory requested, “a copy of the PHS investigation report.” Previous Appeal This request was the subject of a previous appeal. See SPR25/1014 Determination of the Supervisor of Records (April 24, 2025). In my April 24, 2025 determination, I advised the School that G. L. c. 214, § 1B did not allow for the withholding of the responsive record and further ordered the School to clarify its claims under Exemption (c). Subsequently, the School responded on May 6, 2025. Unsatisfied with the School’s response, Ms. Batory petitioned this office, and this appeal, SPR25/1259, was opened as a result. It is my understanding that the subject matter of this request and the issues raised in Ms. Batory’s appeal are similar to those addressed in SPR25/1209 Determination of the Supervisor of Records (May 15, 2025). In my May 15th determination, the School was ordered to provide this office with un-redacted copies of the responsive records for in camera inspection. In light of this order, I decline to provide a determination as to the public status of the requested records at this time pending an in camera inspection of the records. The School is ordered to provide a copy of the responsive records for an in camera inspection without delay.
