Assistant Corporation Counsel Office of the Legal Advisor Boston Police Department 1 City Hall Square Boston, MA 02201 Dear Attorney O’Donnell: I have received the petition of Attorney Christian A. Williams appealing the nonresponse of the Boston Police Department (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On April 24, 2025, Attorney Williams requested the following: [1] All training materials, manuals, guides, presentations, videos, e-learning modules, and documentation related to the Mark 43 Records Management System (RMS) and Computer Aided Dispatch (CAD) software currently in use by the Boston Police Department. [2] All technical specifications, user guides, quick reference sheets, and troubleshooting guides provided to Boston Police Department personnel regarding the use of the Mark 43 software. [3] Records of any contracts, memoranda of understanding, or agreements between the Boston Police Department and Mark 43, Inc. related to training services or materials. [4] Any departmental policies, procedures, or directives governing the use of the Mark 43 system within the Boston Police Department. Claiming to not yet have received responsive records, Attorney Williams petitioned this office and this appeal, SPR25/1300, was opened as a result. Subsequently, I learned that the Department provided the requestor with a response on May 9, 2025. Where this appeal was opened as a result of the Department’s lack of a written response, I will now consider this administrative appeal closed. The requestor may appeal the substantive nature of the Department’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
