See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On April 25, 2025, Mr. Ripley requested the following records: [1] Documentation that evidences Brockton Area Transit Authority policies & procedures on BAT Bus drivers eating and drinking food & beverages while operating a BAT Bus in traffic. [2] Documentation that evidences Brockton Area Transit Authority requirements on what language/s BAT Bus drivers are required to speak & understand. [3] What is/are Brockton Area Transit Authority procedures for an elderly disabled rider to request BAT to come to his Brockton Housing Authority property for the elderly and disabled and answer tenant questions regarding their concerns for their safety when riding BAT? Claiming to not yet have received responsive records, Mr. Ripley petitioned this office and this appeal, SPR25/1312, was opened as a result. Subsequently, on May 13, 2025, I learned that the Authority intends on providing a written response to Mr. Ripley. Accordingly, the Authority is ordered to provide Mr. Ripley with said response in accordance with the Public Records Law, its Regulations and this order within ten business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. Mr. Ripley may appeal the substantive nature of the Authority’s response within ninety days. See 950 C.M.R. 32.08(1).
