The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records May 21, 2025 SPR25/1402 Diane Pelland Town Clerk Town of Swansea 81 Main Street Swansea, MA 02777 Dear Ms. Pelland: I have received the petition of Bill Mullaly appealing the nonresponse of the Town of Swansea (Town) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On April 29, 2025, Mr. Mullaly requested “[c]opies of records verifying [an identified individual]’s qualifications to serve as an appointed Tree Warden: Bachelor of Science Degree in Agriculture/Urban Forestry or a related degree; Arborist certificate; MA Pesticide License; years of supervisory experience in commercial or municipal tree care, qualified by training and experience in the field of arboriculture (localities where employed/contracted included), licensed with the Department of Food and Agriculture in accordance with the provisions of section ten of Chapter one hundred and thirty-two B, and any other license or certificate not listed but related to this request.” Claiming to not yet have received responsive records, Mr. Mullaly petitioned this office and this appeal, SPR25/1402, was opened as a result. Subsequently, I learned that the Town provided Mr. Mullaly with a response on April 29, 2025. Where this appeal was opened as a result of the Town’s lack of a written response, I will now consider this administrative appeal closed. Mr. Mullaly may appeal the substantive nature of the Town’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
