See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). In two separate requests on April 11, 2025 and May 2, 2025, Mr. Wiley requested the following: SPR25/1411: 1. Full Investigation Records for Each Suspicious Activity Report For each of the 56 reports labeled as “suspicious activity”: • The initial call or complaint narrative, including incident number, location, and nature of the report[;] • The investigative steps taken: interviews, follow-ups, evidence collection, and incident closure protocols[;] • The assigned officers and supervisory personnel involved[;] • Audio/video footage, MDT logs, and internal communications relating to each report[;] • Whether the incident escalated or was reclassified (e.g., to a criminal matter, mental health response, or unfounded claim)[;] • Any relevant supervisory review or internal audit. 2. Chief James Lovell SPR25/1411; SPR25/1413 Page 2 May 28, 2025 • The chain of command and approval behind the investigation’s handling or conclusion[;] • Any record showing interaction (or deliberate non-interaction) with me as the complainant or reporting party[;] • Communications (email, text, memos, notes) discussing the case internally[;] • All investigative action logs, timestamps, and disposition documents[;] • Any involvement of the ADA, supervisors, or external review bodies. 3. Comparative Analysis Matrix To assess whether Incident #23011525 was treated disparately, I request a comparative 3 breakdown showing[;] • The number of suspicious activity reports that were fully investigated[;] • How many involved interviews or communication with the reporting party. • How many resulted in action, arrest, or further legal response[;] • Any categorization of complaints by seriousness, location, or public safety relevance[;] • Any record that may suggest bias, retaliation, or deviation from standard procedure in my case versus others. SPR25/1413: 1. A complete copy of the narrative report or police report sent to POST by the Danvers Police Department in response to POST Commission outreach regarding Case #7152[;] 2. A copy of the email or correspondence from Danvers Police Department to [an identified individual], referenced in the March 5, 2024, POST Notes[;] 3. Any attached documentation, statements, internal memos, or supplemental files that were submitted alongside the police report to the POST Commission in this case[;] 4. Any written interpretation or summary from Danvers PD clarifying how the narrative or report allegedly fails to support the complainant’s allegations of discrimination based on sexual orientation or abuse of power. Claiming to not yet have received responsive records, Mr. Wiley petitioned this office and the following appeals, SPR25/1411 and SPR25/1413, were opened as a result. Subsequently, I learned that the Department provided Mr. Wiley with a response on May 27, 2025. Where these appeals were opened as a result of the Department’s lack of a written response, I will now consider these administrative appeals closed. Mr. Wiley may appeal the substantive nature of the Department’s May 27th response within ninety (90) days. See 950 C.M.R. 32.08(1).
