The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records May 28, 2025 SPR25/1412 James Lovell Police Chief Danvers Police Department 120 Ash Street Danvers, MA 01923 Dear Chief Lovell: I have received the petition of Shawn Wiley appealing the nonresponse of the Danvers Police Department (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On April 29, 2025, Mr. Wiley requested the following: [1] Copies of the following public records related to [an identified] Detective of the Danvers Police Department [2] Employment History and Promotions: Dates of employment and service records; Records of promotions, including dates and positions attained; Performance evaluations and commendations. [3] Disciplinary Actions and Investigations: Records of any internal affairs investigations involving [the identified] Detective; Disciplinary actions taken, including reprimands, suspensions, or terminations; Complaints filed against [the identified] Detective, whether by colleagues or members of the public. [4] St. John’s Preparatory School Incident (May 2023): All reports, findings, and communications related to the accidental discharge of [the identified] Detective[’s] firearm during the swatting incident at St. John’s Prep; Internal investigation documents, including conclusions and any corrective actions taken; Correspondence between the Danvers Police Department and other agencies regarding this incident. [5] Training and Certifications: Records of completed training programs and certifications; Attendance at professional development or continuing education courses. Claiming to not yet have received responsive records, Mr. Wiley petitioned this office and this appeal, SPR25/1412, was opened as a result. Subsequently, I learned that the Department provided Mr. Wiley with a response on May 27, 2025. Where this appeal was opened as a result of the Department’s lack of a written response, I will now consider this administrative appeal closed.
