The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records May 28, 2025 SPR25/1416 James Lovell Police Chief Danvers Police Department 120 Ash Street Danvers, MA 01923 Dear Chief Lovell: I have received the petition of Shawn Wiley appealing the nonresponse of the Danvers Police Department (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On April 29, 2025, Mr. Wiley requested the following: [1] All documents, recordings, notes, or investigative material reviewed, received, or generated by the Chief of Police . . . in relation to validating or supporting the police report written by Officer . . . on or around June 15, 2023, regarding Incident #23011525 / SPR25/0682. [2] Any internal memoranda, summaries, or communications by or to Chief . . . referencing direct evidence—not third-party hearsay—used to substantiate the decision to close the case without further action, as referenced in the MCAD Position Statement submitted by DPD. [3] Evidence logs, interview transcripts, call records, or corroborative material received from any internal or external investigative source, including but not limited to alleged complainants, witnesses, or officers, that formed the basis for the department’s claim of conducting a “thorough investigation.” Claiming to not yet have received responsive records, Mr. Wiley petitioned this office and this appeal, SPR25/1416, was opened as a result. Subsequently, I learned that the Department provided Mr. Wiley with a response on May 27, 2025. Where this appeal was opened as a result of the Department’s lack of a written response, I will now consider this administrative appeal closed.
