Poirier City Clerk City of Gloucester 9 Dale Avenue Gloucester, MA 01930 Dear Ms. Poirier: I have received the petition of Michael Bertolino appealing the nonresponse of the City of Gloucester (City) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On May 7, 2025, Mr. Wiley requested the following: All emails regarding [an identified individual] sent and received from January 01, 2017 to May 07, 2025 from any and all members of the Building Department lnspectional Services also included is all emails from [an identified individual] to the State Board of Electrical Examiners, Investigators, State Board Lawyers, or any other government employee. Claiming to not yet have received responsive records, Mr. Bertolino petitioned this office and this appeal, SPR25/1459, was opened as a result. Subsequently, I learned that the City provided Mr. Bertolino with a response on May 27, 2025. Where this appeal was opened as a result of the City’s lack of a written response, I will now consider this administrative appeal closed. Mr. Bertolino may appeal the substantive nature of the City’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
