Connors appealing the nonresponse of the Board of Registration in Medicine (Board) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). This request includes any report prepared by the Division of Law and Policy (DPL).; [7] Any and all Board of Registration in Medicine information, protocols, policies, procedures, guidelines, administrative requirements or like documents, without limitation as to form, regarding Policy 19-04 revised on July 18, 2024; [8] Any and all Board of Registration in Medicine information, protocols, policies, procedures, guidelines, administrative requirements or like documents, without limitation as to form, regarding the preclusive effect, in a Board action, of a final judgment against a physician in a medical malpractice lawsuit; and [9] Any and all Board of Registration in Medicine documents, including prior Board decisions and/or DALA decisions, in which the Board has taken the position that it may discipline a physician for malpractice based on a final judgment against the physician in a medical malpractice lawsuit. Claiming to not yet have received responsive records, Attorney Connors petitioned this office and this appeal, SPR25/1508, was opened as a result. Despite being notified of the opening of this appeal, it remains unclear whether the Board has provided a response. Accordingly, the Board is ordered to provide Attorney Connors with a response to her request, provided in a manner consistent with this order, the Public Records Law and its Regulations within ten (10) business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us.
