Assistant District Attorney Appeals and Training Bureau Middlesex District Attorney’s Office 15 Commonwealth Avenue Woburn, MA 01801 Dear Attorney Horn: I have received the petition of Altin Berxhiku appealing the nonresponse of the Middlesex District Attorney’s Office to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On May 13, 2025, Mr. Berxhiku requested the following: [1] Copies of the following records regarding the former Middlesex District Attorney’s Office employee whose email address has been deactivated and who, according to a May 12, 2025 communication with the Supervisor of Records …, is no longer employed by your office: [2] Official record of termination or resignation, including date of separation from the Middlesex District Attorney’s Office; [3] Documents stating or referencing the reason for the individual’s departure, including termination notices, resignation letters, or internal memos; [4] Any disciplinary actions, reprimands, or findings of misconduct issued against the individual during their tenure; [5] Any documentation or internal correspondence referencing this employee’s performance as a Records Access Officer, including but not limited to public records response evaluations, complaints, or compliance assessments; [6] Payroll or employment roster records indicating the last active day of employment and employment classification; One Ashburton Place, Room 1719, Boston, Massachusetts 02108 • (617) 727-2832 • Fax: (617) 727-5914 sec.state.ma.us/pre • pre@sec.state.ma.us Meagan Horn, Esq. SPR25/1509 Page 2 May 30, 2025 [7] If this individual was reassigned to another public agency, please provide any documentation of such transfer or interagency employment notification. Claiming to not yet have received responsive records, Mr. Berxhiku petitioned this office and this appeal, SPR25/1509, was opened as a result. Subsequently, I learned that the Office provided Mr. Berxhiku with a response on May 14, 2025. Consequently, I will now consider this administrative appeal closed. It is my understanding that Mr. Berxhiku appealed the Office’s May 14, 2025 response, resulting in a new appeal which was opened as SPR25/1378. A determination was issued separately for that appeal on May 30, 2025. See SPR25/1378 Determination of the Supervisor of Records (May 30, 2025).
