Records Access Officer University of Massachusetts President’s Office One Beacon Street Boston, MA 02108 Dear Attorney Flaherty I have received the petition of Yvan Miklin appealing the nonresponse of the University of Massachusetts President’s Office (Office) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On May 16, 2025, Mr. Miklin requested: [1] [T]he awarded contract for the “UMass Chan Medical School Fitness Center Management” services, awarded approximately five years ago[;] [2] [A] copy of the winning proposal submission[;] [3] [A] copy of the executed contract or agreement[;] [4] [C]opies of all other proposals submitted in response to the related solicitation[;] [5] [E]valuation/selection documentation used in the award Decision[.] Claiming to not yet have received a response, Mr. Miklin petitioned this office and this appeal, SPR25/1553, was opened as a result. Subsequently, I learned that the Office intends on providing a written response to Mr. Miklin. Accordingly, the Office is ordered to provide Mr. Miklin with a response in accordance with the Public Records Law, its Regulations and this order within ten business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. Mr. Miklin may appeal the substantive nature of the Office’s response within ninety days. See 950 C.M.R. 32.08(1).
