Records Access Officer Assistant General Counsel Massachusetts Bay Transportation Authority 10 Park Plaza, Suite 3910 Boston, MA 02116 Dear Attorney Ciollo: I have received the petition of Esmy Jimenez, of the Boston Globe, appealing the response of the Massachusetts Bay Transportation Authority (MBTA) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On June 4, 2025, Ms. Jimenez requested the following: Contracts or agreements between the MBTA (or its third-party advertising vendors such as Outfront Media or JCDecaux) and Wynn Resorts, also known as Encore Boston Harbor for advertisements on MBTA property, including: - MBTA buses, trains, trolleys - MBTA stations - MBTA-owned or operated billboards - Bus shelters I am interested in invoices, billing records, or payment documentation related to those advertisements, as well as records or metadata identifying the physical location of these ads, including: station names, bus shelter addresses, bus/train routes where ads were placed, and any media plans or placement reports, if available. I am also interested in any documents that indicate target demographics or audiences, including any emphasis on neighborhoods such as Chinatown, Quincy, Malden, and Everett. Please limit the request to records created or maintained from May 1, 2023 through the present. The MBTA responded on June 4, 2025, and assigned reference number R000688-060425 to this request. Unsatisfied with the MBTA’s response, Ms. Jimenez petitioned this office, and this appeal, SPR25/1591, was opened as a result. Subsequent to the opening of this appeal, the MBTA provided a further response to Ms. Jimenez and this office on June 18, 2025.
