Assistant City Solicitor Law Department City of Brockton 45 School Street Brockton, MA 02301 Dear Attorney Fischer: I have received the petition of Michael Thomas appealing the response of the City of Brockton (City) to a request for public records. See G. L. c. 66, § l0A; see also 950 C.M.R. 32.08(1). On February 28, 2025, Mr. Thomas requested, “[an identified individual’s] check history from 9/28/2003 to 2/28/2025 [and] any and all emails, text messages or any documents sent between [an identified individual] or any member of the finance office, [an identified individual] or any member of the Auditor’s office, [an identified individual] or any member of the city law office, [identified individuals] regarding the [identified individual’s] paying back the school committee stipend that was paid to him including rettro on 2/9/2023.” The City provided a response on March 5, 2025, March 13, 2025, March 28, 2025, and April 10, 2025. Unsatisfied with the City’s responses, Mr. Thomas petitioned this office and this appeal, SPR25/1659, was opened as a result. Subsequently, I learned that the City provided a further response to Mr. Thomas on June 18, 2025. Where this appeal was opened as a result of the City’s previous responses, I will now consider this administrative appeal closed. Mr. Thomas may appeal the substantive nature of the City’s June 18th response within ninety (90) days. See 950 C.M.R. 32.08(1).
