Records Access Officer Assistant General Counsel Department of Children and Families 1 Ashburton Place, 3rd Floor Boston, MA 02108 Dear Attorney Treat: I have received the petition of Mark Simoneau appealing the response of the Massachusetts Department of Children and Families (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On March 13, 2025, Mr. Simoneau sought, “…all 51A and 51B reports pertaining to [identified individuals].” The Department responded on May 20, 2025, June 4, 2025, and June 11, 2025. Unsatisfied with the responses, Mr. Simoneau petitioned this office and this appeal, SPR25/1691, was opened as a result. Subsequently, I learned that the Department provided Mr. Simoneau with supplemental responses on June 17, 2025 and June 25, 2025. Where this appeal was opened as a result of the Department’s May 20th, June 4th, and June 11th responses, I will now consider this administrative appeal closed. Mr. Simoneau may appeal the substantive nature of the Department’s June 17th and June 25th responses within ninety (90) days. See 950 C.M.R. 32.08(1).
