See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On April 7, 2025, Mr. Lev requested the following records concerning an April 4, 2025 incident: [1] Citation & Incident Documentation: a. A full copy of citation T3243776, including both CAD printout and scanned handwritten original, if available[;] b. Officer’s notes, logs, or records related to the stop[;] c. Incident reports, supplemental forms, narratives, or other documentation generated or filed by MSP[;] d. Internal communications (emails, memos, CAD chats, dispatch notes, etc.) related to the stop[;] e. Directed patrol orders, enforcement memos, or deployment logs for the area at the time. [2] Video & Audio Evidence: a. Dashcam, cruiser, or body-worn camera (BWC) footage from the stop, including all associated metadata[;] b. Radio and dispatch recordings from the time of the stop[;] c. Footage or stills from nearby traffic or surveillance cameras (I-391 Exit 3) between 21:00–21:30 on 4/4/2025[;] [3] Vehicle & Equipment Records a. Identification of cruiser(s) used (year, make, model, plate, assignment)[;] b. Allison Mondello SPR25/1702 Page 2 June 25, 2025 -Calibration and certification records[;] -GPS/AVL[;] -PA/Siren/Lights[;] -Camera systems[;] -Officer Information[;] -Officer’s full name and badge number[;] -Shift assignment and patrol logs for 4/4/2025[;] -List of all citations issued by the officer that day[;] -Certification/training records for visual speed estimation[;] -Any complaints, internal affairs investigations, or disciplinary records involving the citing officer. Claiming to not yet have received responsive records, Mr. Lev petitioned this office and this appeal, SPR25/1702, was opened as a result. Despite being notified of the opening of this appeal, it remains unclear whether the Department has provided a response. Accordingly, the Department is ordered to provide Mr. Lev with a response to his request, provided in a manner consistent with this order, the Public Records Law and its Regulations within ten (10) business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us.
