Deputy City Solicitor City of Somerville – Law Department 93 Highland Avenue Somerville, MA 02143 Dear Attorney Shapiro: On June 23, 2025, this office received your petition on behalf of the City of Somerville (City) requesting a waiver of statutory limits to fees that may be assessed in responding to the request and requesting permission to charge for time spent segregating or redacting responsive records. G. L. c. 66, § 10(c); G. L. c. 66, § 10(d)(iv); see also 950 C.M.R. 32.06(4). As required by law, it is my understanding that the City furnished a copy of the petition to the requestor, David Chritson. G. L. c. 66, § 10(c); G. L. c. 66, § 10(d)(iv)(2). On June 9, 2025, Mr. Chritson requested “[a]ll public records – regardless of physical form or characteristics – including, but not limited to, physical papers, investigative records, and case records, made or received by SPD Officer [identified individual] . . ., from July 19, 2021 to March 17, 2023, and involving [an identified individual].” Subsequent to the opening of this petition, in an email to the City and this office on June 27, 2025, Mr. Chritson stated, “I hereby withdraw my public records request related to SPR25/1797…” In light of the decision to withdraw the request, I find it is unnecessary to opine on the City’s fee petition at this time.
