Mayotte Town Clerk Town of Townsend 272 Main Street Townsend, MA 01469 Dear Mr. Mayotte: I have received the petition of Pen Pineapple Apple Pen (requestor) appealing the nonresponse of the Town of Townsend (Town) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On June 5, 2025, the requestor sought “all emails sent or received by [an identified individual] between the hours of 11:00 PM and 4:00 AM from July 1, 2024, to the present[.]” Claiming to not yet have received responsive records, the requestor petitioned this office and this appeal, SPR25/1863, was opened as a result. Subsequently, I learned the Town intends on providing a written response to the requestor. Accordingly, the Town is ordered to provide the requestor with said response in accordance with the Public Records Law, its Regulations and this order within ten business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. The requestor may appeal the substantive nature of the Town’s response within ninety days. See 950 C.M.R. 32.08(1).
