Assistant Corporation Counsel City of Fall River One Government Center Fall River, MA 02722 Dear Attorney Howayeck: I have received the petition of Collin Dias appealing the nonresponse of the City of Fall River (City) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On June 4, 2025, Mr. Dias requested the following records: [1] All emails to and from Interim CFO [identified individual] with the following key words: School School [sic] Department NSS Net School Spending DESE End of Year Report Superintendent School Committee[;] [2] All emails to and from Interim CFO [identified individual] and any email domain that ends with @fallriverschools.org . . . [including] all records within the years 2024 and 2025. Previous Petition This request was the subject of a previous petition from the City. See SPR25/1710 Determinations of the Supervisor of Records (June 17, 2025 and July 10, 2025). In my June 17th determination, I found that the City had established a good cause for a time extension of 30 business days. In my July 10th reconsideration determination, I respectfully declined to reverse my findings in the June 17th determination. Claiming to not yet have received responsive records, Mr. Dias petitioned this office and this appeal, SPR25/1926, was opened as a result. In an email dated July 15, 2025, the City responded “[we] do not intend to provide any response in addition to what I wrote to your office on July 3rd. That being said, the records Mr. Dias has requested will be sent to him by the end of the week.” Conclusion Based on the City’s July 15themail correspondence, which indicates that the City intends to provide responsive records, I will now consider this administrative appeal closed. Please be advised, the City received approval for a time extension of 30 business days. See SPR25/1710 Determinations of the Supervisor of Records (June 17, 2025 and July 10, 2025).
