The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records July 18, 2025 SPR25/1945 Michael Tencellent Records Access Officer Department of Conservation and Recreation 251 Causeway Street Boston, MA 02114 Dear Mr. Tencellent: I have received the petition of Colman Herman appealing the nonresponse of the Department of Conservation and Recreation (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On June 16, 2025, Mr. Herman requested “[c]opies of and and [ sic] all communications regarding the Friends of the Paragon Carousel for the period April 18, 2025 to the present. Communications include, but are not limited to, emails, text messages, letters, memoranda, faxes, and/or notes.” Claiming to not yet have received responsive records, Mr. Herman petitioned this office and this appeal, SPR25/1945, was opened as a result. Subsequently, I learned that the Department provided Mr. Herman with a response on July 8, 2025. Where this appeal was opened as a result of the Department’s lack of a written response, I will now consider this administrative appeal closed. Mr. Herman may appeal the substantive nature of the Department’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
