Lynds appealing the response of the City of Boston (City) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On May 21, 2025, Attorney Lynds requested the following: All Public Records created and attachments or exhibits thereto for the period July 1, 2024 through the date of this request, which shall include all books, papers, maps, photographs, recorded tapes, financial statements, statistical tabulations, or other documentary materials or data (including emails, text exchanges, chats or other instant messaging, on both private and public email servers), regardless of physical form or characteristics, made or received by an employee, department, board, commission, bureau, division or authority of City of Boston, unless such materials or data fall within one or more of the exemptions found within G. L. c. 4, § 7, (26) as follows: 1. Petition to Designate [a specified address on] Kenton Road as a Boston Landmark (Petition #292.24); 2. Application submitted under Article 85 for [the specified address on] Kenton Road; 3. Changes in Survey Rating Policy by the Boston Landmarks Commission; 4. Changes to the Boston Landmarks Commission’s Petition to Designate a landmark form; 5. Votes and minutes of the Landmarks Commission regarding changes to the Commission’s Survey Ratings Policy; 6. Notices sent by the Landmarks Commission regarding [the specified address on] Kenton Road; 7. Study Reports prepared by the Landmarks Commission or a third party for [the specified address on] Kenton Road; 10. Legislation to amend Chapter 772 of the acts of 1975 including any home rule petitions approved by the Boston City Council; 11. Communications regarding re-consideration of a petition to designate [the specified address on] Kenton Road as a Landmark; 12. Communications regarding the approval of a Final Study Report for [the specified address on] Kenton Road as a Landmark; 13. Communication regarding recording of a Notice in the Suffolk Registry of Deeds regarding [the specified address on] Kenton Road; 14. Communication regarding public notice for the designation hearing of [the specified address on] Kenton Road as a Landmark; 15. Communication regarding [four individuals] as it relates to the Petition to designate [the specified address on] Kenton Road a Boston Landmark; 16. Communications between Landmark Commission Staff or other City Employee and any member of the Boston Landmarks Commission regarding [the specified address on] Kenton Road. The City responded on June 5, 2025, and assigned reference number R002544-052125 to this request. Unsatisfied with the City’s response, Attorney Lynds petitioned this office, and this appeal, SPR25/1969, was opened as a result. Subsequent to the opening of this appeal, I learned that the City provided a supplemental response to Attorney Lynds on July 16, 2025. As this appeal was opened based on the City’s June 5th response, I will now consider this administrative appeal closed. If unresolved issues remain, Attorney Lynds may further appeal the substantive nature of the City’s July 16th response within ninety (90) days. See 950 C.M.R. 32.08(1).
